Data Security & Privacy Notice
Intro
We, the persons identified in Art. 1 below, take data security and protection seriously, and are committed to approach it transparently, ethically, according to best practices, in compliance with the GDPR and much beyond our obligations under the Russian law (compliance with which, in our opinion, does not necessarily prevent what would be deemed malpractice in other, most developed, jurisdictions).
1. Who exactly has physical access to your data, and what are their privileges
1.1
Baranchikov IP is a business entity with unlimited liability, registered at Ladozhskaya St. 2/37, suite 110, Moscow 105005, Russia (statutory seat) with VAT № 773126022940; visiting and mailing address is at Maly Cherkassky 2, 2nd floor, Moscow 109012, Russia; email address: info@baranchikov.com; telephone number: +7 495 662 80 05.
1.2
Baranchikov IP is not a legal entity enjoying special regime for rendering professional legal services; while such types of entities formally exist under the Russian law, they are [a] deemed non-profit, which often creates conflict of interest and/or inability of compliance; [b] are subject to special taxation, which, in case of full compliance, is competitively prohibitive; [c] can only be formed by admitted attorneys-at-law.
1.3
None of the persons identified in Art. 1 are admitted attorneys-at-law, as the latter [d] enjoy only limited legal professional privilege, which is not extended to their non-admitted partners and employees including certified lawyers, paralegals, and staff; [e] enjoy additional powers only in criminal proceedings, but in neither civil- nor administrative litigation, in comparison with non-admitted certified lawyers.
1.4
Alexander Baranchikov, certified lawyer, Russian patent and trademark attorney № 1719 — is the managing partner having sole personal liability for obligations of Baranchikov IP to the extent of all his property; Alexander is the only person having full access to the data collected and processed by Baranchikov IP, as per its internal policy, subject to possible exemption as explained in para. 1.9 below.
1.5
No data protection officer (DPO) has been appointed at Baranchikov IP, as [f] there is no such legal obligation and [g] combining the roles of the managing partner and DPO by the only person who has full access to the data would constitute a conflict of interest defeating the purpose of voluntary DPO appointment.

None of the below persons are formally equity partners or shareholders of other kind at Baranchikov IP; while limited liability companies or joint-stock companies are widely used in Russia for establishing law firms, in our opinion, this does not provide for an adequate level of transparency and liability as the listed shareholders are not always the factual partners, and their actual roles or liability are often not clear.
1.7
Oleg Abramenko, Russian patent and trademark attorney № 1905, Eurasian patent attorney № 436 — is a partner of Baranchikov IP in accordance with a joint partnership agreement, which is not foreseen by the law in Russia, but has been concluded due to observing best practices; he has agreed that his access to the data of Baranchikov IP is partial, subject to provisions of the partnership agreement.

Maria Baranchikova, certified lawyer — is a partner of Baranchikov IP in accordance with the joint partnership agreement, which is not foreseen by the law in Russia, but has been concluded due to observing best practices; she has agreed that her access to the data of Baranchikov IP is partial, at discretion of Alexander Baranchikov, with whom she is also bound by spousal privilege as is respected by applicable legislation.

There is a technical mechanism in place to the effect that in case Alexander Baranchikov loses access to the data of Baranchikov IP for one reason or another, Maria Baranchikova will automatically gain full access to the data after a certain period of time; in case she cannot gain or loses access to the data, Oleg Abramenko will automatically gain full access to the data after a certain period of time.
1.10
Elena Vygotskaya, certified lawyer, certified translator — is an of counsel of Baranchikov IP in accordance with an agreement between said parties containing non-disclosure and other provisions aimed at data protection; she has limited access to the data of Baranchikov IP; there is no condition under which she will automatically gain full or partial access to the data outside of the limited access.

The limited data protection regime described in para. 1.10 above also applies to other of counsels, employees, and co-operators of Baranchikov IP and its partners, who are identified in paras. 1.4, 1.7 & 1.8 above, not separately mentioned in this data security & privacy notice; such persons are not meant when hereinafter referring to “us” (“we”, “our”, “ours”) and are jointly referred to as the persons of the “Limited Circle”.

Other than the aforementioned persons legally bound to keep the data they have access to confidential on terms of Baranchikov IP and/or privileged, certain controllers and processors of data may have restricted access to your personal and/or sensitive data; any such controllers and processors are identified below, either directly or jointly, along with their jurisdictions, roles, and relevant documents.
2. To whom and under what conditions we may disclose your data against our will
2.1
Considering the limitations of the legal privilege Russian legal professionals, including us, have at their disposal, we rely substantially on end-to-end encryption of data in conjunction with the fact that under the Russian law we are obliged to neither surrender cryptographic keys, nor supply decrypted data to anyone including law enforcement agencies or even court.
2.2
To ensure confidentiality of data we execute various forms of deniable encryption; a prominent example of that is our internal policy in accordance to which before travelling to jurisdictions with mandatory key disclosure or mandatory decryption laws we will make sure that our mobile devices do not contain any sensitive information, or means of accessing it, and are isolated from our data environment.
2.3
To make sure the end-to-end encryption that we use for sensitive data is not flawed, we use open-source encrypting software with wide supporting communities, in which we also participate by making selective source code reviews; in addition, we have internal security policies in place covering wide spectrum of measures including two-factor authentication, physical control of devices, using VPN, etc.
2.4
In accordance with the Russian law, we do enjoy the right of silence as well as limited spousal privilege which we may or may not be able to use in order to prevent disclosure of information that we know, and remember, to law enforcement agencies and/or court in case of being subpoenaed and interrogated under criminal proceedings; at that, in such situation we may be forced to disclose your information.
3. How emails, our primary communication channel, are protected

Any emails sent to us are first received by our email service provider's servers physically located in Switzerland; plain-text emails are immediately encrypted with our PGP public key and after that may be decrypted only on our devices; analogous procedure is used for emails sent by us; thus, all emails exchanged with us from outside of Russia are not accessible from its territory by anyone including the state.

By design, delivery of emails may sometimes be delayed due to various technical errors; in this view, we routinely confirm receipt of instructions and other time-sensitive email communications; in case you have not received from us either a confirmation of receipt or a substantive response within twenty-four hours, we suggest that you would reach us by phone to check if we have received you email.
4. Where and for how long data is stored by us, and how it is protected
4.1

All the data in our possession is physically stored on secure servers in Europe; copies of some of the data may be also temporarily stored on our mobile devices, which must be physically controlled by us at all times, with one or more layers of encryption; we may also backup the data to physical media, applying excessive level of both physical and cryptographic protection thereto.
4.4
The data collected by us is only stored in an accessible way for as long as necessary for the respective purpose for which a particular piece of data has been collected; this includes both your and our own purposes, as well as the purposes dictated to us by applicable regulations such as for accounting to tax authorities or to prove our qualification to state bodies when applying for professional certification.
5. How paper documents are received, docketed, and stored or utilised
5.1

Original documents received by us are either stored in a secure facility (guarded by private security officers, equipped with an intruder- and fire-alarm, in burglar- and flame-protected safes), or used for their intended purposes (such as filed with relevant authorities or handed over to specified parties), or securely disposed.
6. What is our approach to using phones, text messages, messaging apps and such
6.1
There is no technical way to secure telephone communications; hence, we suggest that you do not share with us any personal or sensitive information over the phone or via text messages; this is also generally applicable to third-party messaging services, especially those integrated to social and professional networking platforms.
6.2
We normally only accept calls from, but do not make calls to, clients; in case you receive a call from someone who claims to be us or our representative, we advise you to check that claim, for example, by ending the call and calling back to our number.

None of the data collected at our websites and processed by us allows us to personally identify our website visitors; we exclusively process said data for the purpose of tracking of a course the users use our websites and to create reports on the website activity, which are reviewed online, within the web analytics interface, to improve the content and usability of our websites.

8. If you have received a newsletter from us and want to do something with it
8.1

We note that in case described in point [q] above we will delete your name but will keep you email address — stored as per point [n] above — along with marking it “unsubscribed” to make sure a newsletter is never sent again to said email address; in case of option in point [r] above we will have no way of making sure you will never receive a newsletter again, for example, due to presenting us with another name card.

If you instruct us with a professional matter, this gives us a Mandate to provide you with legal assistance. We assume by default that you are a referrer, which means that you act professionally on behalf of the client, but not the actual client — i.e. the final beneficiary of our legal services. We will only consider for the purposes of conflict checks actual clients, which are those who have provided us with a power of attorney.
9.2
Other than processing the client's data in order to fulfil our Mandate, perform conflict checks, and for compliance with legal obligations to which we are subject as per Art. 6, subpara. 1, point (c) GDPR (such as providing our banks with the invoices containing client's data), we may ask for your consent to the following:

11. If you are an interested referrer or agent: what data we store, and how process it
11.1
In case you have sent us a request via email, paper mail, or telephone; have provided us with your name card, brochure and/or similar material during a professional event such as conference, congress, etc; had a scheduled meeting with us during or outside of a professional event, such as in your or our offices or public space, — we consider you an interested party, which includes both potential referrers and agents.
11.2
Due to reciprocal nature of relations between firms in the intellectual property field, we do not practically distinguish between interested referrers and interested agents (those who we are considering as potential agents for our clients' instructions abroad). At that, we never solicit instructions from interested parties, and so their data collected and processed by us is structured and used only to work with agents.
11.3

At that, we may collect and process data that is required in order to fulfil the Mandate given to us by our client, which constitutes our legitimate interest as per Art. 6, subpara. 1, point (f) GDPR in connection with recital 47 GDPR.
